Privacy Policy 


This Privacy Policy explains how InvestorTesting Inc. collects and uses information that you provide through our website at (the “Site”) and through the software applications (the “Software”) that we make available for use on or through computers and mobile devices, including our desktop and mobile applications (“ Apps”) (collectively, including the Site, Software, and Apps, the “Services”). By providing Personal Information to us, you acknowledge that you have read and understand this Privacy Policy.

Personal Information Personal Information We May Collect

Personal Information” is information that identifies you as an individual or relates to an identifiable person. We and our service providers may collect Personal Information such as name, email address, mailing address, and telephone number.

If you become a participant in one of our online studies (a “Participant”), we may also request information about methods for making payments to you, such as your PayPal account information.

Participant Recordings

If you become a Participant and wish to participate in one of our online studies, you will need to download our Software application (the “InvestorTesting Recorder”). When you launch a study, the InvestorTesting Recorder will start recording the session through your computer or other device (“Device”), including (a) video recording from your camera and (b) audio recording from your microphone (the “ Participant Recordings”). We treat Participant Recordings as Personal Information for purposes of this Privacy Policy.

The Participant Recordings also may capture any other person in range of the camera and/or microphone of your Device, as well as your surroundings. We do not wish to obtain video or audio content of any person other than the Participant. If you are a Participant, you should participate in a location where your Device will not capture video or audio of any other person. If another person may be seen or heard in your Participant Recordings, you are responsible for notifying the individual in advance and obtaining his or her express consent to the recording. Similarly, do not disclose any personal information or other information during your recorded session that you would not want to be shared with others. Please note that you can turn off the Participant Recordings at any time during the session by exiting the InvestorTesting Recorder.

How We May Use Personal Information

We and our service providers may use Personal Information (including Participant Recordings):

  • To respond to your inquiries and fulfill your requests.
  • To send administrative information to you, for example, information regarding the Services and changes to our terms, conditions, and policies.
  • To invite you to participate in online studies.
  • To complete and fulfill your transaction, for example, to process payments made to Participants, communicate with you regarding your transactions and provide you with related customer service.
  • For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying our Services, identifying usage trends, determining the effectiveness of our studies and promotional campaigns, conducting studies and analyzing the results of studies, and operating and expanding our business activities.
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may also use Personal Information and Participant Recordings in generating studies and reports for our clients, in providing products and services to our clients, in conducting data analyses, and in developing and enhancing our own offerings.

How Personal Information May Be Disclosed

Your Personal Information may be disclosed:

  • To our third party service providers who provide services such as natural language processing (including speech to text transcription and text analysis to assess user sentiment), emotion metrics and analysis, and other analysis of Participant Recordings, data analysis, payment processing, customer service, email delivery, auditing and other similar services.
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
  • To our clients, as discussed below.
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Please note that we may use a third-party payment service, currently PayPal, to process payments made to Participants. The information you provide to this third-party payment service, and the information that we provide to this third-party payment service in connection with processing payments to you, will be subject to that third party’s privacy policy rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your Personal Information.

Important Note for Participants:

If you participate in an online study we are conducting for one or more clients (including their representatives and service providers), we may disclose your Personal Information and Participant Recordings to such clients, including but not limited to your survey responses and the full video, audio, and screen content from your Participant Recording(s) from the study. If you do not wish for your Personal Information or Participant Recordings to be disclosed to our clients, you should not participate in our studies. Please note that we do not control how our clients may use the information we provide to them, that this Privacy Policy does not address the privacy practices of our clients, and that we are not responsible for the privacy practices of our clients.

From time to time, a client may wish to engage in further discussions with a Participant from a study. We may share the Participant’s name and contact information with the client for purposes of facilitating further communications related to the study, if the Participant has authorized us to do so.

We also may disclose Participant Recordings and other Personal Information about a Participant on our website and in our promotional materials, to the extent authorized by that Participant in connection with his or her participation in our studies.

OTHER Information

Other Information We May Collect

Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual, such as:

  • Browser and device information
  • App usage data
  • Information collected through cookies, pixel tags and other technologies
  • Demographic information and other information provided by you
  • Aggregated information

For example, we may request demographic information from Participants such as gender, age, job type, income level, education, social media platforms used, family status, hobbies, survey responses, and other information useful in screening or segmentation for purposes of conducting research projects (collectively, “Demographic Data”).

When Participants engage in our studies, we also collect screen recordings that captures anything visible on the screen of the Device during the session, as well as computer screen actions, screen shots, clicks, navigational data, and other detail about use of the Device during the session (collectively, the “Device Usage Data”).

Demographic Data and Device Usage Data are Other Information as long as they do not relate to an identified or identifiable individual. If Demographic Data or Device Usage Data are linked to an identified or identifiable individual, we treat that information as Personal Information as long as it remains linked.

How We May Collect Other Information

We and our third party service providers may collect Other Information in a variety of ways, including:

  • Through your browser or device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Services (such as the App) you are using. We use this information to ensure that the Services function properly.
  • Through your use of our Apps and Software: When you download and use the App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number. Our Apps and Software also collect information from your device as part of the Participant Recordings, including but not limited to details of your visits to the websites or software we ask you to test, such as click-flow data, traffic data, location data, weblogs, IP address, operating system, browser type, and other communication data.
  • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other website traffic data. We and our service providers use the information for security purposes, to facilitate navigation, display information more effectively. We can recognize your computer to assist your use of the Services. We also gather statistical information about the usage of the Services in order to continually improve the design and functionality, understand how the Services are used and to assist us with resolving questions regarding the Services.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or be given the choice of declining or accepting the transfer to your computer of a particular cookie (or cookies) from a particular site. However, if you do not accept these cookies, you may experience some inconvenience in your use of the Services. For example, we may not be able to recognize your computer and you may need to log in every time you visit the applicable Services.

  • Google Analytics: Our Services use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). This analytical tool uses cookies and similar technologies to help analyze how users use the Services. The information generated about usage, including visitor IP address, is transmitted to Google. This information is then used to evaluate visitors’ usage, compile statistical reports on website activity, and provide other services relating to website activity and Internet usage.   • Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Services to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Services and response rates
  • IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice and is done automatically by many websites, applications and other services. We use IP Addresses for purposes such as calculating usage levels of the Services, helping diagnose server problems, and administering the Services.
  • From you: Information such as your location, as well as other information, such as your preferred means of communication, is collected when you voluntarily provide this information.
  • From participation in a study: As part of some online studies, a Participant may be asked to complete tasks or forms that require the Participant to enter information such as shipping address or method of payment during an e-commerce experience. The InvestorTesting Recorder provides functionality that allows the Participant to obscure these data fields from the Participant Recordings that we store and maintain. Please note that the Participant must follow the instructions given within the Software, at the time and in the sequence in which they are given, in order to prevent the storage of this information.
  • By aggregating information: Aggregated Personal Information does not personally identify you or any other user of the Services, (for example, we may aggregate Personal Information to calculate the percentage of our users or Participants who have a particular telephone area code).

How We May Use and Disclose Other Information

Please note that we may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use it for all the purposes for which we use and disclose Personal Information.

In some instances, we may combine Other Information with Personal Information (such as combining your name with the state in which you live). If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.


This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including our clients or any third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.


We seek to use reasonable organizational, technical and administrative measures to protect Personal Information that we maintain within our organization. We also seek to use third-party service providers capable of protecting the information they maintain or process for us. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.


If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving them by clicking on the “unsubscribe” link provided in the email. Please also note that if you do opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, and you cannot opt-out from receiving administrative messages.

If you would like to update Personal Information that you have provided to us, you may log into your online account with us or contact us by contacting us in accordance with the “Contacting Us” section below.


The Services are not directed to individuals under the age of thirteen (13), we request that these individuals do not provide Personal Information through the Services. We do not knowingly permit these individuals to provide Personal Information through the Services.


The Services are controlled and operated by us from the United States, and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.


We may change this Privacy Policy. Please take a look at the “Last Updated” legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you understand and acknowledge the revised Privacy Policy.
